To access certain resources of the Platform whether through the web or the mobile application, Patients must provide BeFree, which acts as a mere manager of the Platform, and, where applicable, the Psychologists certain personal data (the “Personal Data”). BeFree and, where applicable, the Psychologists will process the Personal Data for the purposes and under the conditions defined in their respective privacy policies: The Personal Data Protection Policy of the Platform, Data Protection Policy of the Psychologists (“Informed consent and privacy policy”, shared by the Psychologist once services commence) and in the corresponding cookies Policy.
In any case, the User guarantees the authenticity and current status of all data communicated to BeFree through the Platform, being the User the sole responsible for their statements and updates.
The provision of the service has, in principle, an indefinite duration. However, BeFree is authorized to terminate or suspend, in whole or in part, the provision at any time, without prejudice to the respect for the contractual commitments specifically assumed in exchange for an economic consideration and by virtue of specific conditions distinct from these Legal Conditions. The termination of the service in whole or in part shall not obligate BeFree to notify Users in advance.
Any User may terminate the use of the Platform at any time.
Neither the Patient nor the Psychologist may assign the Contractual Relationship, in whole or in part, and the rights or obligations arising from it without prior express and written authorization from BeFree. BeFree (or whoever operates the Platform at any time) may assign the Contractual Relationship, in whole or in part, and all or some of the rights or obligations arising from it to any third party of its choice, without prior authorization from the Users or prior notification to them, which will allow the possibility of transferring to that third party the corresponding Personal Data for the exploitation of those rights or the fulfillment of the Contractual Relationships in which that third party is subrogated as a consequence of the transfer, within the scope provided in the Privacy and Cookies Policy published.
All communication between the parties must be made in writing, whether by mail, fax, chat, or email sent, in the case of BeFree, to the addresses indicated in the Legal Conditions. In the case of the User, communications may be sent to the contact details provided by them and also by publishing a notice in the form of a banner or otherwise to notify of certain changes. Communications made by letter with acknowledgment of receipt and those made by telegram, fax, chat, or email shall be deemed duly delivered and received when proof of receipt can be provided. Any communication sent to the addresses provided by the Users shall be understood to have been correctly made, unless they have previously notified BeFree of a change of address with a minimum notice of 15 business days.
Users are aware that BeFree may modify these Legal Conditions and the Contractual Relationship at any time without the need to inform them. Users should periodically consult the Legal Conditions to know their applicable version at any time.
The present Legal Conditions are the express manifestation of the will of the parties regarding their object and invalidate any verbal or written agreements reached prior to their acceptance by the User.
In case of discrepancy between the versions of the Legal Conditions, Data Protection Policy, and Cookies and any other documentation provided in different languages by BeFree, the Spanish version will prevail, as long as it is legally possible.
The declaration of nullity or invalidity of any clause contained in the present Legal Conditions will not affect the validity and effectiveness of the other clauses, which will be interpreted and applied in the most lawful sense closest to what would arise from the application of the null clause.
The waiver by either party to comply with any of the provisions of these Legal Conditions by the other party will not constitute a waiver of the right to demand compliance with the rest of the provisions of these Legal Conditions or any other obligation. The delay or omission by the parties in exercising any right that corresponded to them by virtue of the Legal Conditions will not constitute a waiver of the corresponding right either.
The Contractual Relationship shall be governed by Colombian law.
Except in cases of consumers, including Users who have that consideration, who will follow the provisions of the Law, Users and BeFree submit, waiving any other jurisdiction that may correspond to them, to the Judges and Courts of the city of Manizales (Colombia) in relation to any dispute regarding the validity, effectiveness, compliance, interpretation, execution or any other matter related to the Contractual Relationship.
