What is BeFree?

What is BeFree?

BeFree is an online platform, accessible through BeFree's web portal (www.befreementalhealth.com) or from BeFree's proprietary mobile application (the ‘Platform’), which is made available to Patients from:Internet Clients of BeFree's partners who are beneficiaries of BeFree's partner programmes.Employees of BeFree's client companies (beneficiaries of a company programme in which BeFree pays in full for the services provided to its employees or provides them with a discount code). The Platform is made available to the aforementioned Patients interested in sharing their concerns and interests with the psychologists (the ‘Psychologists’) in order to obtain psychological assistance services from them, so that they can establish contact with each other and manage their professional relationship by making available to them the communication functions available on the Platform (the ‘Communications’). The Patients and the Psychologists shall be jointly referred to as the ‘User(s)’.

  1. The provision of services is carried out by Psychologists to Patients. Communications are offered and provided exclusively by Psychologists, on their own behalf and in their own name, and not by BeFree. BeFree does not provide professional services but rather serves as a tool that facilitates therapies between Psychologists and Patients. BeFree solely connects Psychologists and Patients while also providing the technical means to make these Communications possible. Therefore, only Psychologists are responsible for any claims from Patients or third parties related to Communications or the conduct of the Psychologists in general. BeFree is entirely uninvolved in the provision of Communications by Psychologists or their conduct. Psychologists provide their services with full autonomy and independence. To use the platform, Users must be over 14 years of age and have parental or guardian consent, or be of legal age and have full legal capacity. The use of the Platform by children under 14 years of age is expressly prohibited. Users explicitly commit to making proper use of the Communications and the Platform. Specifically, they agree to: Use it on their own behalf, under their sole responsibility, and for personal purposes. Not use it for profit, promotional, or commercial purposes, such as promoting their own establishment or services or harming those of others, without prejudice to the lawful professional activity of Psychologists. Not archive, download, reproduce, distribute, modify, display, perform, publish, license, create derivative works, sell, or (unless expressly authorized in these Legal Terms) use content or information contained in the Platform service or obtained through it. Not disseminate content that is criminal, violent, pornographic, racist, xenophobic, offensive, supportive of terrorism, or generally contrary to law or public order. Not introduce computer viruses or perform actions that could alter, damage, interrupt, or generate errors or damage to the electronic documents, data, or physical and logical systems of BeFree or third parties; nor block other Users' access to the website and its services by consuming massive computer resources through which BeFree provides its services. You also agree not to upload, post, email, or transmit any material designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment associated with the service provided through the Platform, such as computer viruses or other computer codes, files, or programs. We may terminate or restrict your use of the service if you breach these Legal Terms or if you engage in illegal or fraudulent use of the service. Do not attempt to access other Users' accounts or restricted areas of BeFree's or third-party computer systems or extract information from them. Do not infringe on privacy, image, honor, data protection, intellectual or industrial property rights, nor violate the confidentiality of BeFree’s or Users' information. The content of Communications must be kept confidential by the Psychologists, who will maintain the utmost confidentiality and adopt appropriate security measures. Do not impersonate other Users, public administrations, or third parties. Do not reproduce, copy, distribute, make available, or in any other way publicly communicate, transform, or modify the content available on the Platform or in any of the portals and mobile applications unless authorized by the rights holder or legally permitted. Do not collect data for advertising purposes, nor send advertising or sales communications or others of a commercial nature without prior request or consent. All content on the Platform and in the mobile application, such as texts, photographs, graphics, images, icons, technology, software, as well as its graphic design and source codes, constitute a work whose ownership belongs to BeFree, and no rights of exploitation over them are understood to be transferred to the User beyond what is strictly necessary for the proper use of the Platform. Likewise, all trademarks, trade names, or distinctive signs of any kind that appear on the Platform or in any of the portals and mobile applications that are owned by BeFree (or third parties with which BeFree has agreements), do not confer any right to the User over them by their use or access. The distribution, modification, assignment, or public communication of the content and any other act that has not been expressly authorized by the holder of the exploitation rights is prohibited.

The mere use of the Platform automatically entails the full and unreserved acceptance by the User of each and every one of these Legal Conditions in the version published by BeFree at any given time. Consequently, the User must periodically read the Legal Conditions in order to be aware of any variations, which need not necessarily be notified. In addition to the Legal Conditions, any other general and/or specific conditions subscribed to by Users in relation to the use of certain resources and/or contents made available to them on the website or in the mobile application shall also apply to them. In the event of a conflict between these Legal Conditions and other conditions specified for a specific area or service of the Platform, the latter shall prevail with regard to the use of or access to that area or service of the Platform. Likewise, in the event of any conflict between any particular terms and conditions and any general terms and conditions, the particular terms and conditions shall prevail. The set of terms and conditions resulting from the Legal Conditions and the various general and specific conditions applicable to each User in relation to the service shall be referred to as the ‘Contractual Relationship’.

Registration on the Platform through the website www.befreehealth.ai or the mobile application is necessary to receive the Communication services and, where applicable, to browse and enjoy certain functionalities in various sections of the website or mobile application. Specifically, Patients can register via email and password. The collection, processing, and purpose of personal data use are governed by the provisions outlined in these Legal Terms as well as the Platform's Data Protection Policy and Cookie Policy. Additionally, the Patients' personal data will be processed by the Psychologists for the purposes included in the “Informed Consent and Privacy Policy” document shared by the Psychologist once the service provision with the Patient begins. It will be understood and presumed that the personal data provided by Patients to use the Communication services have been entered directly by the Patient, and therefore, the Patient will be solely responsible for its accuracy or inaccuracy. BeFree may also enable other registration methods if applicable, in which case, Patients should consider whether the registration is carried out directly on the Platform by the means determined by BeFree at each moment (for example, completing the form provided on the website or responding to questions posed via phone or email) or through third-party platforms. In the latter case, you must take into account the legal and privacy conditions applicable to those platforms, for which BeFree is not responsible. To use the Platform hosted on www.befreementalhealth.com or its mobile application, you must have access to the internet and a compatible device. Neutral position of BeFree and disclaimer regarding Communications Regarding Communications, BeFree will only act as a provider of intermediary services for hosting and linking content (primarily the Communications). BeFree exercises no control or supervision over the content of the Communications. As such, BeFree is not obligated to review content uploaded or posted on the Platform by Users, including Communications. The content uploaded or posted by Users, including Communications, is created, hosted, and shared by the Users. Therefore, BeFree assumes no responsibility for such content. The provisions of this paragraph are without prejudice to the content detection and removal procedures outlined below. You release BeFree from any liability concerning your participation in the Communications or the use of content created by other Users, including any acts or omissions by the Psychologists or Patients. We make no representations or warranties regarding any content or Communications. The relationship between the Patient and the Psychologist is direct and exclusive, without BeFree's involvement, as BeFree does not validate or control the Communications or other services provided by the Psychologists to the Patients. Therefore, you should maintain the appropriate level of care, attention, and diligence. The advice given by the Psychologist is not and cannot be equivalent or a substitute for medical advice. Lastly, as a Patient, you should be aware that the services provided by the Psychologists through Communications are not a substitute for, nor equivalent to, a face-to-face session with a Psychologist. You should assess the advantages and disadvantages of using an online platform via Communications to obtain the services of the Psychologists and decide whether they meet your needs. Psychologists are not employees, collaborators, or representatives of BeFree; they are independent service providers who only use the Platform to offer their professional services to Patients and receive compensation for doing so. Consequently, Patients are clients of the Psychologist, paying the Psychologist directly, who will then issue the corresponding invoice for the services provided. Each Patient must manage their relationship with the Psychologists independently and according to their own judgment. Users agree that any legal action or civil liability they seek for acts or omissions by Psychologists, Patients, or third parties must be directed exclusively at them and not at BeFree. Both the Psychologist and the Patient will indemnify and hold BeFree harmless from any damages resulting from a claim, whether judicial or extrajudicial, by a Patient, Psychologist, or third party for any reason related to their conduct on the Platform. This indemnity obligation will extend to BeFree, its affiliated entities, subsidiaries, administrators, employees, collaborators, and agents. The indemnity obligation will include legal representation and assistance costs and other legal or procedural expenses. Notwithstanding the above, Users may and must report any irregularities or violations they detect concerning other Users. In such cases, BeFree may: Remove, cancel, and/or report to the competent authorities any acts, omissions, or content of Users that are contrary to the Contractual Relationship, the Law, or the rights of third parties, including intellectual property, industrial property, image rights, privacy, and honor rights. This includes the right to disclose the identifying data (and other legally relevant data) of Users likely responsible for reported violations to the competent authorities and third parties with a legitimate legally protected interest, in compliance with personal data protection regulations. Cancel the account of any User who has committed such acts or omissions or is responsible for such content. BeFree reserves the right to maintain or restore the content or an account if it is proven that a request was false or abusive; and to cancel the account of the User who falsely reported, or to take any other appropriate action. BeFree may take, at its sole discretion and judgment, the measures it deems appropriate for the better functioning of the Platform and greater satisfaction of Users, including setting restrictions, barriers, or automatic measures to prevent conduct contrary to the Legal Terms, without assuming any liability for such actions. Reports must be sent, under the responsibility and commitment that the provided information is accurate and truthful, specifying the following details: (i) personal data to identify and contact the complainant; and (ii) specification of the alleged illegal activity carried out on the Platform and justification thereof, including, where applicable, identification of infringed rights, the infringing acts, and their location on the Platform. These notifications must be sent to quieroserlibre@befreementalhealth.com and must include the subject line: “User Report.” BeFree may, at its discretion, make other mechanisms available for Users to make these notifications. Exclusion of obligations and warranties regarding the provision of the Platform Concerning the service provided by BeFree (that is, providing the Platform to facilitate contact between Patients and Psychologists) and which are distinct from the services provided by Psychologists to Patients, BeFree assumes only the contractual obligations outlined in these Legal Terms and provides no warranties to Patients.

  1. The actions or omissions of the Psychologists, for which they are solely responsible. In this regard, you should review the warnings made in section 3 of these Legal Terms. The proper, continuous, or uninterrupted operation of the website and/or mobile application, which BeFree may cease at any time at its discretion, without prejudice to the contractual commitments specifically assumed in exchange for financial compensation and under conditions different from these Legal Terms. Similarly, BeFree does not guarantee the compatibility of the website and/or mobile application with the access devices of Users, whether they are computers, browsers, mobile devices, or other types of devices. The accuracy of advertisements or sponsored content on the website and/or mobile application, for which the advertiser or sponsor is responsible. The adequacy of the Platform to the needs or expectations of Users. The level of satisfaction, quality of life, gain or profitability, or the absence of losses or damages as a result of using the Platform. The truthfulness, accuracy, and validity of the data corresponding to Users. The solvency, technical, commercial, moral, or financial reliability of Users. The legality, accuracy, truthfulness, and validity of what Users state in Communications or on the website and/or mobile application. The conclusion, successful outcome, or regularity of the contracts or agreements made between Patients and Psychologists. The proper storage, preservation or lack thereof, or loss of the contents or statements of Users in Communications or on the Platform. The inability to access the website, the existence of flaws and defects of all kinds in the content transmitted, disseminated, stored, made available, or accessed through the website and/or mobile application or the services offered. The presence of viruses or other elements in the content that may cause alterations to the computer systems, electronic documents, or data of Users. The breach of laws, good faith, public order, trade customs, and this legal notice as a result of improper use of the Platform. In particular, and by way of example, BeFree is not responsible for the actions of third parties that violate intellectual and industrial property rights, trade secrets, rights to honor, personal and family privacy, and personal image, personal data protection, as well as unfair competition and illegal advertising regulations. Any liability concerning information found outside the Platform (i.e., the website or mobile application). The purpose of the links that appear on the Platform is solely to inform Users about the existence of other sources that may expand the content offered through the Platform. The functioning or accessibility of the linked sites is not guaranteed either; BeFree neither suggests, invites, nor recommends visiting them, and therefore is not responsible for the outcome obtained. BeFree is not responsible for hyperlinks established by third parties. The establishment of a hyperlink does not imply any relationship between BeFree and the owner of the website where it is established, nor acceptance and approval by BeFree of its content or services. Those intending to establish a hyperlink must first request written authorization from BeFree. In any case, the hyperlink will only allow access to the homepage of the site www.befreementalhealth.com or the mobile application. You must refrain from making false, inaccurate, or incorrect statements about BeFree, the Platform, or any element derived from it, or from including illegal content that is contrary to good customs and public order. BeFree is not responsible for the use that each User makes of the materials made available on the website and the mobile application, nor for the actions taken based on them. THE SERVICES AND INFORMATION CONTAINED ON THE PLATFORM ORGANIZED BY BEFREE (THAT IS, DIFFERENT FROM COMMUNICATIONS) ARE OFFERED “AS IS,” “AS AVAILABLE,” AND WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, SUCH AS TITLE WARRANTIES, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES FOR ANY PERFORMANCE OR COMMERCIAL USE, WHICH ARE EXPRESSLY EXCLUDED. BEFREE, AND OUR DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS DO NOT WARRANT THAT: (I) THE SERVICES WILL BE SECURE OR AVAILABLE AT A SPECIFIC TIME OR ON A SPECIFIC WEBSITE; (II) DEFECTS OR ERRORS WILL BE CORRECTED; (III) THE CONTENT OR SOFTWARE AVAILABLE ON, OR THROUGH, THE SERVICES WILL BE VIRUS-FREE OR FREE OF OTHER HARMFUL COMPONENTS; (IV) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS. YOU SHOULD BE AWARE THAT YOU USE THE SERVICES AT YOUR OWN RISK. The price to be paid to Psychologists for Communications and to BeFree for making the Platform available. The price for therapy services (the Communications) will be paid directly by Patients to the Psychologists and will depend on the plan subscribed and selected by the Patient. BeFree does not charge Patients for making the Platform available so that they can inquire about the services of Psychologists. However, BeFree may charge Patients for certain intermediary services it provides (for example, fees for processing subscription plan modifications). In such cases, the Patient will be properly informed beforehand. Payment for services provided by the Psychologist will be made through the payment system or gateway. BeFree includes a link to the payment gateway for these payments, without receiving any of the amounts or managing the payments between Patients and Psychologists. In any case, payment of the corresponding fee within the agreed-upon timeframe through the payment gateway releases the Patient from liability. This means that once the corresponding payment for the Communications has been made, the Psychologist cannot demand any additional amount for those services from the Patient. Similarly, in cases where Patients are beneficiaries of Corporate Programs (where companies pay for the entirety of the services) or BeFree Partner Programs, payment by the client company or the BeFree partner releases these companies or partners from liability. The price of the Psychologists' services will be charged to Patients, or in the cases of Patients who are beneficiaries of Corporate Programs or Partner Programs, to the Companies and/or Partners, on a recurring basis according to the selected plan and continuously from the subscription date, unless canceled in accordance with these Legal Terms prior to the plan renewal date. The billing date may change (for example, if the payment method was not properly set up or if the subscription started on a day not included in the relevant billing period). The payment system or gateway will be indicated on the Platform at all times and will be operated by a third party who will be, vis-à-vis the Patient, solely responsible for its operation and the handling of their payment data (regardless of whether the gateway is accessible from the Platform or not). Please read the conditions of this third party before accepting the use of their payment system. In any case, its use will require an accepted, valid, legitimate, and current payment method. You can find and modify the specific details of your subscription and payment method on the Platform by visiting our website www.befreementalhealth.com or through our “Befree” app, and by clicking on the “My Subscription” link available in the account settings section. Please note that the issuer of certain payment methods may charge a fee for foreign currency transactions or other charges. Please check with your payment provider for details. The failure to pay any due amount, whatever the reason, (including insolvency, expiration, insufficient funds, or any other reason) will entitle BeFree to suspend your access to the Platform and/or Communications until a valid payment method is provided. The Patient may suspend their subscription at any time and will continue to have access to the Platform and/or Communications until the end of the billing period. If the Patient wishes to revoke their consent given to the Psychologist to terminate the therapy sessions, the Communications, they must notify the Psychologist or write to the following address: quieroserlibre@befreementalhealth.com. If the Patient intends to suspend payment for the service, they can do so in the "My Subscription" section available in the account settings section of the Platform, and if they intend to cancel their account entirely (which will prevent further access), they can do so in the "My Account" section, also through the account settings section. If the Patient signed up using their account with a third party (either entirely or solely for payment purposes) and wishes to cancel their subscription on the Platform, they may have to do so through that third party. For example, they may need to visit their account with the relevant third party and disable automatic service renewal, or unsubscribe from it, through that third party. In such cases, please check with the third party before subscribing from that account.

BeFree reserves the right to freely offer any promotions or discounts under the terms and conditions it deems appropriate from time to time and reserves the right to modify, in whole or in part, these Conditions at any time.Trial Session The Psychologist may offer the Patient a first trial week during which a first session will be offered free of charge. During this trial week, the Patient may freely and at no cost cancel the subscription, however, if the Patient does not express his/her opposition to continue with the service or have more sessions with the Psychologist, it will be understood that the Patient wishes to continue with the initially selected plan and, if applicable, agrees to the automatic renewal.B. Invite a friend All Patients, except those users who belong to Company Programmes or Partner Programmes, have a personal discount code that they can share with other people so that they can register on the Platform. Each time a new Patient registers for the first time on the service using a Patient's discount code, both the new Patient and the Patient whose code has been used will receive a discount. New Patients will benefit from the 20% discount associated with the first subscription and, after the purchase, the Patient whose code has been used will benefit from a 20% discount on their next subscription.C. Invite a professional colleague The psychologists on the platform have a personal code that they can share with new patients and with new psychologists who do not use the tool. Each time a new patient registers for the first time on the service using the psychologist's discount code, the new patient will receive a 20% discount on their first subscription. On the other hand, if the code is shared with a professional colleague, the psychologist who shares his or her personal or referral code will be able to benefit from a discount on the fees for the use of the same. The conditions of the referral code are described on the platform's support page. D. Other Promotions Patients, except those who belong to Company Programmes or Partner Programmes, may benefit from additional promotions on the first subscription (e.g. discount codes) agreed between BeFree and other entities.

Gift Card

Gift Card

BeFree gift cards can be found on the website, in the Gift Card section. Each gift card includes an activation code, which is provided in the downloadable Gift Card file and/or in the confirmation email sent to the recipient once the buyer has completed the purchase. The BeFree Gift Card is valid for 1 year from the date of purchase. The expiration date is indicated in both the purchase confirmation email and the email sent to the recipient. The BeFree Gift Card can only be redeemed for the plan selected by the buyer (weekly or monthly). Refunds cannot be requested by the recipient. However, the buyer has one month from the date of purchase to request a refund. In case of loss or theft of your BeFree Gift Card, and as long as it has not been used in the meantime, you may contact BeFree to request a replacement Gift Card of the same value at no additional cost. The new Gift Card will be sent to the recipient and/or the buyer via email. The recipient and/or the buyer must take appropriate measures to preserve and protect the activation code provided in the downloadable Gift Card file and/or in the confirmation email sent to the recipient. BeFree will not be responsible in the event of public communication and/or disclosure of this confidential information. BeFree reserves the right to reject any claim from a recipient who purchased their Gift Card outside the authorized distribution network, especially in the case of purchasing from an individual or non-official website. Any claims or requests for information, particularly regarding the purchase, refund, redemption, or functioning of BeFree Gift Cards, should be addressed to BeFree via our website in the "Contact" section. The use of the BeFree Gift Card by the person utilizing the card implies acceptance of these general terms of use. BeFree reserves the right to modify these General Conditions at any time, with the understanding that such modifications will not apply to Gift Cards used prior to the modification of these General Conditions. The previous General Conditions will apply to Gift Cards used before the new modifications.

Password and account access

The User who has created an account on the Platform via the website (www.befreementalhalth.com) or the mobile application, must maintain control over it by preventing access by third parties. To this end, the User must not disclose to anyone the password or the details of the account or the associated means of payment (for example, the last four digits of your credit or debit card, or your email address).


Users should be careful with any communication asking them to send their credit card, payment method or, in general, their account information, as this may result in identity theft and other financial damages. You should always access your information directly from any of the linked web portals or from the official mobile application and not through a hyperlink in an email or any other electronic communication, even if it appears official. We may cancel your account or block it for security reasons.


BeFree's intellectual and industrial property rights and over the contents provided by the User.

BeFree is the owner or, where applicable, holds the corresponding licences for the intellectual and industrial property exploitation rights of the ‘BeFree’ Platform and any of the web portals or mobile applications linked to it.


Under no circumstances shall it be understood that access to, browsing and use of the Platform, web portals or mobile application implies a waiver, transmission, licence or total or partial transfer of said rights by BeFree. Users have the right to use the contents and/or services of the Platform within a scope strictly in accordance with the terms established in these Legal Conditions.


References to registered trademarks or trade names, or other distinctive signs, whether owned by BeFree or by third parties, imply a prohibition on their use without the consent of BeFree or their legitimate owners.


All intellectual and industrial property rights over the contents and/or services of the Platform of the linked website (www.befreementalhealth.com) and the mobile application are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of its contents without the prior, express written authorisation of BeFree or, where applicable, of the holder of the corresponding rights.


In the event that the User sends to, uploads to or publishes on the website or the mobile application information or content of any kind (including through the Communications), he/she declares, guarantees and accepts that he/she has the right to do so freely, that said information does not infringe any intellectual or industrial property rights, trade secrets or any other rights of third parties, and that said information is not confidential or harmful to third parties. The User assumes full responsibility for these acts, holding BeFree harmless for any damage or harm suffered as a result, directly or indirectly, of them.


The contents that the User uploads or publishes on the website and mobile application other than those exchanged by means of the Communications shall be referred to as ‘User Content’. In general, BeFree does not ‘use’ User Content. BeFree merely provides the technical means for Users to create, host, make available, use and access such content. However, in certain circumstances and jurisdictions, it may be necessary or desirable for BeFree to have a license to provide the Services (hereinafter, the ‘Use for the Provision of the Service’). The User therefore authorises BeFree to use, for the entire world and for the entire duration of the term thereof, all intellectual property rights (including those of reproduction, distribution, public communication or transformation), industrial property, image or any other rights relating to the User Content on any known media (the ‘Licence for the Provision of the Service’). The Licence for the Provision of the Service shall include, if necessary or convenient for such purpose, BeFree's right to create and exploit, to the same extent as indicated in this paragraph, works derived from the User Content.


Apart from the foregoing, BeFree may make use of the User Content for the sole purpose of demonstrating the operation of the Platform in order to promote it, to improve it or adapt it to the trends or tastes of the Users and in general to develop its business (the ‘Own Use’).


To the extent necessary or appropriate for carrying out the User's Own Use, the User authorises BeFree to exploit, for the entire world and for the entire legal term, all intellectual property rights (including those of reproduction, distribution, public communication or transformation), industrial property, image or any other rights relating to the User Content provided by the User on any known media (the ‘Licence for Own Use’ and, together with the Licence for the Provision of the Service, the ‘Licences’). The User's use of the Service does not constitute a breach of any kind of third party's obligations, nor does it constitute unfair competition. In the event that there is any doubt as to the lawfulness of the use of such User Content on the Platform, the portals linked thereto and in the mobile application, BeFree recommends that Users avoid using such User Content.The Licence for Own Use shall include BeFree's right to create and exploit, to the same extent as indicated in this paragraph, works derived from the User Content. This right of BeFree is granted on a non-exclusive, irrevocable, free, universal and fully sub-licensable basis.The License to Provide the Service also includes the right (but not the obligation) to retain a backup copy of such User Content for the purpose of evidencing Therapyside's or a User's compliance with legal obligations or to cooperate with public authorities for a maximum period of time corresponding to the statute of limitations for such legal obligations.The termination of the User or of the User Content shall not affect the Own Use Licence, which may be used for the entire legal duration of the rights relating to them, with the exception of the possibility of expressly revoking the authorisation with respect to those very personal rights in which the Law provides for this possibility (such as the right to the User's image).The User guarantees to BeFree that he/she has the necessary rights to grant the Licences and that the use of the intellectual, industrial, image or any other type of property rights in accordance with what is provided for does not constitute a legal infringement, nor does it infringe the rights of any type of third party, nor does it breach obligations contracted with third parties, nor does it constitute unfair competition.
